Terms and Conditions

1. Acceptance of Terms
By purchasing, enrolling in, or accessing any online or in-person course (“Course”) provided by The Smith Investigation Agency Inc., Smith Security Inc., and/or Training Centre Canada Professional Education Inc. o/a Training Centre Canada (collectively referred to as “the Companies,” “we,” “us,” or “our”), you (“student,” “you,” or “your”) agree to comply with and be bound by these Terms and Conditions.
2. Course Access and Use
All Courses are designed to meet or exceed relevant provincial and federal standards where applicable. Access to Courses is granted solely to the registered student for personal, non-commercial educational use. Course access may not be shared, transferred, copied, or resold. Students are responsible for ensuring they have the necessary technology, internet connection, and digital literacy to complete their Course.
3. Course Completion and Certification
Each Course includes modules, lessons, and assessments that must be completed to receive a certificate or Training Completion Number (TCN), where applicable. It is the student’s responsibility to review all materials, complete required work, and retain information necessary to pass any internal or government-administered examinations.
The Companies are not liable for any student’s failure to pass an exam, licensing test, or certification issued by a third party or regulatory authority.
4. No Refunds or Exchanges
All Course purchases are final. Due to the immediate access to digital content upon purchase, no refunds, exchanges, or transfers will be issued under any circumstances. Please review Course details carefully before making a purchase.The Companies are not liable for any student’s failure to pass an exam, licensing test, or certification issued by a third party or regulatory authority.
5. Compliance and Quality Assurance
The Companies’ Courses are continuously reviewed to ensure compliance with Ministry, regulatory, and industry standards. Content and delivery methods may be updated or modified at any time to maintain current best practices and legal accuracy.
6. Student Conduct and Academic Integrity
Students must complete their own work honestly. Any attempt to cheat, share content, provide false information, or allow others to complete coursework on their behalf may result in suspension or removal without refund, and certificates or TCNs may be revoked.
7. Privacy and Information Sharing
By enrolling, you consent to the collection and use of your personal information for Course administration, certification, and compliance verification. The Companies may share relevant information (e.g., name, certificate number, completion date) with provincial or federal ministries, regulators, or partner organizations as required.
We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
8. Technical Issues
While we strive to maintain uninterrupted access, the Companies are not responsible for service interruptions caused by device issues, user error, internet connectivity, or third-party platform outages. Support is available for troubleshooting during regular business hours.
9. Limitation of Liability
To the fullest extent permitted by law, the Companies and their affiliates, officers, employees, and instructors shall not be liable for any direct, indirect, incidental, or consequential damages resulting from participation in any Course, loss of data, exam failure, or delays in certification.
10. Modifications to Terms
The Companies reserve the right to modify these Terms at any time. Updated Terms will be posted on our websites and will apply to all subsequent purchases.
11. Intellectual Property, Unauthorized Use, and Enforcement
a. Ownership. All Course content, including text, videos, images, assessments, designs, slide decks, branding, and all other materials (collectively, “Course Content”) are the exclusive property of The Smith Investigation Agency Inc., Smith Security Inc., and Training Centre Canada Professional Education Inc. o/a Training Centre Canada. All rights are reserved.
b. Licence. Upon purchase, you are granted a limited, non-exclusive, non-transferable licence to access Course Content for personal, educational use only. This licence does not grant any right to copy, record, reproduce, distribute, sell, or modify the materials.
c. Prohibited Conduct. You may not use Course Content to create, train, or market any competing course or product. You may not reproduce our course structure, video style, voiceovers, visual design, or written content. Any purchase made with the intent to copy or steal content will be considered an act of infringement.
d. Misuse & Enforcement. The Companies maintain relationships with multiple provincial and federal ministries, regulatory authorities, and licensing bodies. Any individual or organization found to have copied, stolen, or misappropriated Course Content, in whole or in part, will be subject to legal action to the fullest extent permitted by law, including injunctions, statutory damages, and civil claims.
e. Indemnity. You agree to indemnify and hold harmless the Companies against any claims, damages, or expenses (including legal fees) arising from your unauthorized use or reproduction of Course Content.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute shall be resolved exclusively in the courts of Ontario.
13. Severability
If any portion of these Terms is held invalid or unenforceable, the remainder shall remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between you and the Companies with respect to Course participation and supersede any prior representations or communications.
